TITLE: Labor & Employment Counsel

LOCATION: Atlanta, GA (hybrid)

POSITION SUMMARY

NCR's Law Department covers a full range of legal matters, including securities law compliance, mergers and acquisitions, intellectual property development and protection, commercial negotiations, corporate governance, employment matters and litigation.

This is a hands–on role for an experienced employment counsel with significant experience in all aspects of labor and employment and related litigation legal practice. As a member of the NCR Law Department, the Counsel, Labor & Employment will provide NCR HR Leadership team with legal support on labor, employment and dispute resolution as well as to the HR professionals and teams in the company and to management organizations in the US and globally.

The Counsel, Labor and Employment will be based in Atlanta, GA. Some travel will be required. The role will report to the Law Vice President–Litigation and will work closely with other attorneys in the Law Department throughout the world.

KEY AREAS OF RESPONSIBILITY:

  • Advising on and providing strategic support to business clients, including HR and management, on a diverse and challenging array of employment and labor legal issues as they arise.

  • Proactively preventing or minimizing legal risk to the Company and helping to drive legal strategy to align with and achieve business strategic goals.

  • Supervising outside counsel and managing litigation matters including coordination of fact investigation, drafting and production of discovery, and developing strategy for, drafting and revising litigation briefs and motions.

  • Providing outlooks, managing and reporting legal spend.

  • Investigating and responding to government agency charges and investigations.

  • Providing counsel and advice on union labor matters such as Collective Bargaining Agreement negotiations and management.

  • Researching, remaining up to date on, and reporting on new and emerging developments in the law and providing strategic advice and guidance in support of company compliance with same.

  • Proposing, revising and drafting company policies to ensure labor and employment law legal compliance.

  • Developing strategy for employee dispute resolution.

  • Providing support to contract managers and the business when employment–related contract drafting, interpretation and enforcement issues arise.

  • Providing or supporting HR and business training initiatives concerning employment and labor legal matters.

  • Advising on matters and initiatives that may relate to employee privacy law.

  • Supporting the business on post–employment restrictive covenant issues, such as trade secrets, non–compete and non–solicitation dispute prevention and agreement enforcement.

  • Advising on and assisting compliance with the FLSA and state wage & hour legislation, employee disability management and accommodations, employee background check reviews, FCRA compliance, and temporary workforce management.

  • Providing other necessary general legal advice and counsel to business clients primarily in the areas of employment law, labor law, and dispute resolution, and performing other duties as assigned by supervisor and senior management.

BASIC QUALIFICATIONS:

  • Fully qualified lawyer in the United States and experience with hands–on legal responsibilities for labor and employment in a corporate law department. General knowledge of global issues and trends in employment law and prior global responsibilities and expertise desirable and will provide an advantage

  • At least 10 years' experience practicing law at a major law firm and multinational company, with a focus on labor, employment and related litigation as well as global HR issues

  • Excellent written and oral communication skills including a clear and concise drafting style and ability to communicate orally and in writing with colleagues across the United States

  • Sound user experience with MS Office

  • Occasional travel is required

  • Meticulous attention to detail and strong organizational skills
