What does a successful Sr. Commercial Counsel do?
As a Sr. Commercial Counsel, you would provide legal support to Fiserv's fast–paced, Open–Loop Prepaid business by interpreting applicable laws and regulations; drafting and negotiating agreements with clients and partners; providing counsel to sales, account management, product, and technology leaders on legal and business matters; and liaising with company specialists regarding intellectual property, technology, privacy, security, regulatory, employment, and litigation matters.

What you will do:

  • Providing counsel and legal advice on regulatory matters, strategic initiatives, client, partner and other contracts, intellectual property, dispute resolution, corporate policies and procedures, and administration

  • Working directly with business unit representatives to prepare and negotiate client, partner and other commercial contracts for payroll, funds disbursement, incentive, and gift card solutions

  • Advising business partners on legal, contractual, and risk matters impacting their areas of responsibility

  • Effectively interacting with corporate specialists regarding finance, audit, tax, IT, publicity/press, regulatory, privacy and technology matters that affect the open loop Prepaid business

  • Maintaining knowledge of industry best practices and applicable legislation affecting the open loop Prepaid business operations

  • Developing and maintaining forms of contracts and other legal documentation


What you will need to have:

  • 5+ years of relevant experience negotiating, drafting, and redlining contracts and providing regulatory prepaid program guidance

  • Demonstrated experience working in a highly regulated environment

  • JD from accredited law school

  • Licensed to practice, or ability to become licensed to practice, in appropriate jurisdiction

  • In good standing with State Bar with no disciplinary record


What would be great to have:

  • Prepaid card payments industry experience

  • Knowledge of regulatory requirements for prepaid business (e.g., CARD Act, Prepaid Access Rule, Prepaid Account Rule, AML, Reg E) State Money Transmission laws, state payroll card laws, applicable privacy laws, and Card Association rules

  • Experience interacting with senior management

  • Exposure to financial services and technology contracts

  • Self–assured, driven, independent leader
