Patent Agent, Intellectual Property

The Intellectual Property Legal group at Gilead is seeking a creative, dynamic, and collaborative patent agent to join the patent prosecution team. The Patent Agent will be an integral member of a team of over 30 attorneys, agents, and paralegals that enables Gilead to continue providing therapies to areas of unmet medical need worldwide.

As an individual contributor, the Patent Agent will support small molecule products and product candidates. This position will be located in Foster City and report to the Assoc Director, Intellectual Property & Patent Agent Team Lead.



Essential Duties and Job Functions


The person in this position will, among other things:
  • Work collaboratively with other members of the Intellectual Property Legal team on patent drafting and patent prosecution in US and foreign jurisdictions

  • Independently draft and prosecute patent applications with minimal supervision

  • Be able to identify many of the prosecution issues associated with increasingly complex matters

  • Evaluate tools to improve drafting efficiency and knowledge management

  • Assist in updating and/or maintaining best practice guidelines for patent application drafting and patent prosecution

  • Coordinate with client groups, e.g., to obtain information and feedback related to patent drafting

  • Develop solutions and solve problems related to department processes with ongoing input and oversight from more senior members of the Intellectual Property Legal team

  • Assist with researching routine issues related to patent strategy with assistance from their supervisor, with visibility to senior Company management, and with the ability to analyze and defend analysis

  • lnteract with other functions to optimize collaboration between legal and other functions



Education & Experience


  • Registered to practice before the USPTO

  • 5+ years of patent agent experience and a bachelor's degree or 3 years related experience with a master's degree.

  • Advanced degree in Chemistry or Biochemistry or related sciences preferred

  • Experience in the biotechnology or pharmaceutical industries preferred

  • Must have very in–depth technical skills and expertise depending on area(s) of responsibility

  • Must have excellent written and verbal communications skills

  • Must have strong client service orientation


The salary range for this position is: $129,540.00 – $167,640.00. Gilead considers a variety of factors when determining base compensation, including experience, qualifications, and geographic location. These considerations mean actual compensation will vary. This position may also be eligible for a discretionary annual bonus, discretionary stock–based long–term incentives (eligibility may vary based on role), paid time off, and a benefits package.
