Job Description

Montgomery College, located just north of Washington, D.C. in Maryland, has an immediate need for a full–time Assistant General Counsel in the Office of General Counsel. This is a non–bargaining, exempt, grade 37 position. The normal work schedule is Monday to Friday, 8:30am to 5:00pm. The Assistant General Counsel under supervision and/or direction of the General Counsel, provides or assists in the provision of legal services to the College in specialized areas to ensure maximum protection of the College's legal rights and to ensure that the mission of the College is executed within the limits prescribed by law.

The work involves providing legal advice, counsel, consultation and guidance regarding legal rights, responsibilities, policy alternatives and potential legal liabilities. The incumbent's actions have a wide impact throughout the College, managing institutional compliance with federal, state, and local laws, and practicing preventive law to educate college staff to avoid liabilities. This position will focus primarily in the following areas: labor and employment, student affairs, athletics, campus safety, civil rights, constitutional law, public records, policy development, privacy, intellectual property, conflict of interest, ethics, insurance, risk management and compliance.

Duties include but are not limited to:

  1. Provide legal advice and counsel on full range of human resources matters, including hiring, disability and leave, discipline and termination, investigations, wage and hour, and workers compensation.
  2. Provide legal advice and counsel related to negotiation of labor union contracts and the implementation of negotiated contracts and grievances.
  3. Provide legal advice and counsel on various federal, state and local laws to ensure regulatory compliance.
  4. Provide legal advice and counsel related to all student affairs matters, including athletics, behavioral intervention/crisis teams, FERPA, financial aid, student conduct and discipline, and Title IX.
  5. Represent the College in administrative complaints with external regulatory agencies such as Maryland Commission on Civil Rights, U.S. Equal Employment Opportunity Commission and U.S. Department of Education Office of Civil Rights.
  6. Assist and communicate with Office of County Attorney or outside counsel in employment, tort or other litigation, or directly represent the College in such litigation.
  7. Serves as primary contact and coordinator on public information requests, subpoenas and records retention requirements.
  8. Assist with development and implementation of College policies, procedures and guidelines.
  9. Perform research, draft correspondence, memoranda, templates, releases, and other documents, including employment and settlement agreements.
  10. Engage effectively with colleagues in the Office of the General Counsel, other College units/departments and opposing counsel; assist and manage outside legal counsel when appropriate.
  11. Review and maintain currency with laws and regulations impacting the College; provide training or informational materials as necessary.
  12. Perform other duties as assigned by the General Counsel.

Required Knowledge, Skills and Abilities

  1. Knowledge of the constitutional, statutory and regulatory framework within which the College operates.
  2. Skill in verbal and written communications including interpersonal relations, drafting contracts, negotiation, and formally presenting information.
  3. Ability to provide high level legal advice within assigned areas of expertise.
  4. Ability to work both on a team and independently.
  5. Ability to communicate and work effectively with a wide range of constituencies in a diverse community.
  6. Ability to manage multiple unrelated matters concurrently in a timely and proficient manner.

Required Qualifications:

  1. Juris doctorate or LL.B degree from an American Bar Association accredited law school.
  2. Member of Maryland bar or become a member within one year of date of hire.
  3. A minimum of 3 years of substantial and progressively responsible experience as a practicing attorney working at a higher education institution, federal, state or local government agency, or similar experience at a law firm.
  4. Excellent written and verbal communication skills with the ability to communicate and work effectively with a wide range of constituencies in a diverse community.
  5. Excellent drafting and negotiating skills.
  6. Eligible applicants must currently be authorized to work in the United States and not require employer visa sponsorship.

Hiring Range: $110,133 to $151,447 annually.
